Introduction
Welcome to CrewExpo. These Terms of Use govern your use of our platform. By accessing or using CrewExpo, you agree to be bound by these terms. If you do not agree to these terms, please do not use our platform.
1. Eligibility
You must be at least 18 years old to use our platform. By using CrewExpo, you represent and warrant that you meet this age requirement.
2. User Accounts
Registration: You must create an account to access certain features of our platform. You agree to provide accurate and complete information during registration and to update your information as necessary.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3. Use of the Platform
Acceptable Use: You agree to use the platform only for lawful purposes and in accordance with these Terms of Use. You agree not to use the platform in a way that violates any applicable laws or regulations.
Prohibited Activities: You agree not to engage in activities that could harm the platform or other users, such as spreading malware, harassing other users, or attempting to gain unauthorized access to our systems.
4. Services for Freelancers, Agencies, and Companies
Freelancers (Crews): Crews can create profiles, apply for jobs, and receive offers. Profiles must be accurate and honest. Crews are responsible for the content they post and for maintaining the confidentiality of communications with Clients.
Clients (Agencies and Companies): Clients can post job opportunities, browse Crew profiles, and hire services. Clients must provide accurate job descriptions and requirements. Clients are responsible for the terms and conditions of any agreements they enter into with Crews.
Messaging: Free Client members cannot message Crews. Basic and Premium Client members can message Crews.
Phone and Email: Only Premium Client members can view the phone and email information of Crews.
5. Fees and Payments
Freelancer (Crew) Fees: We offer both free and paid plans for Crews. CrewExpo reserves the right to take a commission on completed jobs. In addition, Crews who opt for the paid (Premium) plan agree to pay a monthly fee. Any applicable fees will be clearly disclosed at the time of use.
Client Fees: We offer three different plans for Clients: Free, Basic, and Premium. The Free (Starter) plan allows companies to operate with no fees within certain limits. Clients can upgrade to the Basic or Premium accounts at any time for additional features and capabilities.
Payment Terms: Payments must be made through the platform’s designated payment methods. Clients make payments to CrewExpo, and once the job is done, Crews get paid within four weeks. Crews with a Premium plan get paid within two weeks.
B2B Section: In this section, CrewExpo facilitates business connections between companies, customers, and service providers. We share requests from customers with our partners and then provide a quote to the customer as CrewExpo. We do not take any commission from customers. Our earnings in this section come solely from our partners.
6. Intellectual Property
Ownership: All content and materials on the platform, including text, graphics, logos, and software, are the property of CrewExpo or its licensors and are protected by intellectual property laws.
License: We grant you a limited, non-exclusive, non-transferable license to use the platform for its intended purpose. You agree not to copy, modify, distribute, sell, or lease any part of our services or software.
7. Termination
We reserve the right to suspend or terminate your account and access to the platform if you violate these Terms of Use or engage in activities that harm the platform or other users. You may terminate your account at any time by following the account termination procedures on the platform.
8. Limitation of Liability
To the maximum extent permitted by law, CrewExpo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform. Our total liability to you for any damages arising from or related to these terms or your use of the platform shall not exceed the amount you have paid us in the past twelve months.
9. Indemnification
You agree to indemnify, defend, and hold harmless CrewExpo, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your use of the platform or your violation of these Terms of Use.
10. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law principles. Any legal action or proceeding arising under these terms will be brought exclusively in the federal or state courts located in Fulton County, Georgia.
11. Changes to These Terms
We may update these Terms of Use from time to time. We will notify you of any changes by posting the new Terms of Use on our website. You are advised to review these Terms of Use periodically for any changes. Your continued use of the platform after the posting of changes constitutes your acceptance of such changes.
